Trademark Rejected in the UAE? Your Options After an Unsuccessful Application

Trademark Rejected in the UAE

Does a rejected application mean we have to abandon the brand? We need to read the decision before answering. A request to amend an application calls for a different response from a refusal based on an earlier trademark.

We at Jitendra Intellectual Property help applicants examine the issue behind a refusal and identify the work needed for their next step.

What Can You Do After a UAE Trademark Application Is Rejected?

Depending on the decision, the options may include meeting the ministry’s conditions, filing a grievance or submitting a revised application. Start with the written reasons and notification date. Changing the logo immediately could leave the actual objection unanswered.

Read the Reasons for Trademark Refusal

A name may lack distinctiveness, mislead customers or conflict with an earlier mark. UAE trademark law recognises these as grounds that can prevent registration.

Identify exactly what the examiner has challenged. If the problem concerns similar wording for related services, changing the background colour may achieve little. The response needs to address the reason given, rather than explain how much the business likes its branding.

Respond to Required Restrictions or Amendments

Some notices require changes rather than closing the application outright. The ministry can impose restrictions or amendments to distinguish a mark from an earlier application or registration.

Read the requested change alongside the response deadline. Decide whether the resulting protection would still cover the business adequately. Silence is risky: failure to respond within the prescribed period can result in the application being treated as waived.

File a Grievance Against the Rejection

The ministry’s registration guidance allows a rejected applicant to challenge the decision before the relevant committee within 30 days of notification.

Preserve the notification itself, including the electronic record. A grievance should explain why the decision should change and connect each argument to supporting material. An informal enquiry about the refusal should not be treated as a substitute for submitting the formal challenge.

Examine Any Earlier Trademark Cited

Where an earlier mark blocks the application, obtain its details and compare the actual goods or services. Looking only at the names can miss the issue.

Different class numbers do not automatically remove a conflict. UAE law states that classification alone does not determine whether goods or services are similar. Any argument for separation must address what the businesses offer, not simply where their applications sit.

Revise the Mark and Consider a Fresh Application

Sometimes the proposed name is too close to an established brand, or too ordinary to distinguish the business. A fresh application may be more practical than defending the original wording.

Search the revised mark before committing to replacement packaging. A new spelling or graphic does not guarantee acceptance. Refilling also does not preserve the deadline for challenging the original refusal.

What Documents Help Support a Trademark Grievance?

Build the file around the refusal reasons. A large collection of advertising materials will not necessarily answer an objection concerning the goods listed in the application.

Useful records may include:

  • The refusal notice and notification evidence.
  • The original application and submitted artwork.
  • Details of any cited earlier marks.
  • Relevant dated evidence of brand use.
  • Previous correspondence with the ministry.

Explain what each document establishes. For example, dated materials may help show when and how a mark was used, but use alone does not resolve every registration obstacle. Keep the original records available alongside the copies submitted.

Can You Challenge an Unsuccessful Grievance in Court?

You can appeal a committee decision to the competent court within 30 days of notification. This is a separate deadline triggered by the committee’s decision. UAE law requires a prior grievance before a lawsuit seeking cancellation of the ministry’s refusal can be accepted.

A legal review should address:

  • The committee’s reasoning.
  • The grounds for challenging it.
  • The evidence supporting those grounds.
  • The applicable filing requirements.

Court proceedings need an assessment of the case itself. Continuing simply because the business has already invested in branding can distract from a weak legal argument. A revised brand may remain an option while the available challenge is assessed.

FAQs

Can I challenge a UAE trademark rejection?

UAE law permits a grievance against rejection. The reasons in the decision determine what arguments and evidence could support it.

Is every trademark examination notice a final rejection?

Not necessarily. Restrictions, amendment requests and final refusals require different responses. Read the notice before deciding which procedure to follow.

Can I submit a new trademark application after rejection?

A revised mark may be filed again, but repeating the rejected application without addressing its defects risks the same outcome.

Can I take a trademark refusal directly to court?

A court challenge to the ministry’s refusal requires a prior grievance. Skipping that stage prevents acceptance of the cancellation lawsuit.

What records should I keep after a trademark rejection?

Keep the refusal notice, notification evidence, original application, cited marks and supporting records directly relevant to the reasons for rejection.
